Welcome to Piqued. These Terms of Use govern your access to and use of the Piqued.fm website and the Piqued FM mobile application (together, our "Service"). By using our Service, you agree to these Terms of Use. Please read them carefully.

1. Use of Our Service

You may use our Service only for lawful purposes and in accordance with these Terms of Use. You may not use our Service:

  • In any way that violates any applicable federal, state, local, or international law or regulation
  • To transmit any unsolicited or unauthorized advertising, promotional materials, or other forms of solicitation
  • To impersonate or attempt to impersonate Piqued.fm or any of our employees, affiliates, or other users
  • To copy, download (except where a download feature is expressly offered), redistribute, publicly perform, re-stream, or scrape audio or other content from our Service outside the Service
  • To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of our Service, or which, as determined by us, may harm Piqued.fm or users of our Service or expose them to liability

2. Intellectual Property

The content on our Service, including text, graphics, images, and software, is owned by or licensed to Piqued.fm and is protected by copyright, trademark, and other intellectual property laws. You may not use any content from our Service without our express written permission. This section does not apply to Artist Contributions, which are governed by Section 4.

3. User Content

You may submit content to our Service, such as comments or reviews. By submitting such content, you grant Piqued.fm a non-exclusive, perpetual, irrevocable, royalty-free, worldwide license to use, copy, modify, create derivative works based on, distribute, and display your content for any purpose. This section applies to text and similar user submissions; audio performances and recordings are governed by Section 4.

4. Artist Contributions and Licensing

This section governs audio and performances contributed to Piqued FM by artists, performers, and DJs ("Artist Contributions"). Our sourcing and rights practices are described in plain language on our Licensing page.

4.1 Ownership stays with the artist. Artists retain all ownership of their Artist Contributions. Piqued FM claims no ownership of an Artist Contribution beyond the license described below.

4.2 License you grant us. By performing at a Piqued FM event that we record, or by submitting any recording, performance, mix, or DJ set to Piqued FM, you grant Piqued FM a non-exclusive, worldwide, royalty-free license to host, store, reproduce, encode, stream, publicly perform, and distribute your Artist Contribution on and through our Service (including the Piqued.fm website and the Piqued FM app), together with the incidental technical copies needed to operate the Service. This license lasts while your Artist Contribution remains on the Service and for a reasonable period afterward needed to remove it from our active systems and backups.

4.3 Your representations and warranties. For each Artist Contribution, you represent and warrant that:

  • the Artist Contribution is your own original work, or you otherwise hold, and have secured, all rights, licenses, consents, and permissions necessary to grant the license in Section 4.2 and to allow Piqued FM to distribute it;
  • to the extent your Artist Contribution (such as a DJ set or mix) incorporates any third-party recordings, compositions, or samples, you have obtained all rights and permissions required for their inclusion and distribution on the Service; and
  • your Artist Contribution does not and will not infringe or violate the intellectual property, privacy, publicity, or other rights of any third party, or any law.

4.4 Responsibility and removal. You are solely responsible for your Artist Contributions. Piqued FM does not pre-clear the rights in Artist Contributions and relies on the representations above. We may remove or disable access to any Artist Contribution at any time, including in response to a rights complaint or to comply with law.

Piqued.fm respects intellectual property rights and expects our users and contributors to do the same.

If you believe that content on our Service infringes your copyright, please send a notice to our designated contact form, that includes:

  1. your name and contact information;
  2. identification of the copyrighted work you claim has been infringed;
  3. identification of the material on the Service you are asking us to remove, with enough detail (such as a URL) for us to locate it;
  4. a statement that you have a good-faith belief the use is not authorized by the rights holder, its agent, or the law;
  5. a statement, under penalty of perjury, that the information in your notice is accurate and that you are the rights holder or authorized to act on their behalf; and
  6. your physical or electronic signature.

We will review valid notices promptly and remove or disable access to infringing material where appropriate. In appropriate circumstances, we will terminate the accounts of, and stop accepting contributions from, contributors who repeatedly infringe.

6. Links to and Embedded Third-Party Content

Our Service may contain links to third-party websites. In addition, the piqued.fm website lets featured artists showcase their own external work by linking to or embedding their profiles and releases on third-party services such as YouTube, SoundCloud, and Bandcamp, surfaced through those services' official embeds and public APIs. Such embedded content is hosted and delivered by the relevant third-party service under its own terms and privacy policy, and is displayed at the contributing artist's direction. This embedding functionality is available on the website only and is not part of the Piqued FM app. We are not responsible for the content, accuracy, or practices of these third-party services, nor do we endorse them, and you access them at your own risk.

Throughout our website and our services, we may use affiliate links for certain third-party products and services. These affiliate links mean that Piqued will earn a commission if a user clicks on these links and subsequently makes a purchase from the third party.

The use of affiliate links does not incur any additional cost to you, the user. Any commission that we receive is paid by the third-party company, not by you.

Please understand that we recommend these third-party products and services because we believe that they will provide value to our users, not because of the commission that we receive from your purchases. However, you should always conduct your own research and make your decisions based on that research, not on our recommendations.

Piqued is committed to transparency and honesty in all of our dealings. We will always disclose when we are using affiliate links, so that you can make an informed decision about whether to use these links.

8. Disclaimer of Warranties

Our Service and its content are provided "as is" and "as available" without warranty of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose. We do not warrant that our Service will be uninterrupted or error-free, or that defects will be corrected.

9. Limitation of Liability

In no event shall Piqued.fm be liable for any indirect, incidental, special, punitive, or consequential damages, or any loss of profits or revenue, whether incurred directly or indirectly, arising from your use of our Service or its content.

10. Indemnification

You agree to indemnify, defend, and hold harmless Piqued.fm and its affiliates, officers, directors, employees, agents, licensors, and suppliers from and against any claims, actions, suits, or proceedings, as well as any damages, losses, liabilities, settlements, judgments, costs, and expenses (including reasonable attorneys' fees) arising from or relating to your use of our Service, your Artist Contributions, or your violation of these Terms of Use, including any claim that content you submitted infringes a third party's rights.

11. Governing Law and Jurisdiction

These Terms of Use shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflicts of law provisions. Any legal action or proceeding arising out of or relating to these Terms of Use shall be brought exclusively in the federal or state courts located in Los Angeles, California.

12. Changes to these Terms of Use

We may update these Terms of Use from time to time. We will notify you of any changes by posting the new Terms of Use on our Service. You are advised to review these Terms of Use periodically for any changes.
